Rapper Julio Foolio Asks Judge To Dismiss Case, Says Ankle Monitor Is “Costly”

FLORIDA- Attorney’s for rapper Julio Foolio have filed a new motion to dismiss the case against him.

The rapper whose real name is Charles Jones, appeared in court Wednesday on charges of fleeing and eluding police during a traffic stop in April, reports FirstCoastNews.

Jones has pleaded not guilty to the charges.

The rapper’s attorney had previously asked the judge to suppress all the evidence against, saying there was no probable cause for the traffic stop, according to FirstCoastNews.

In Jones’ new motion, his attorney is seeking to dismiss the entire case.

According to the motion, “Mr. Jones did not increase his speed, but instead traveled approximately 20 mph without making any evasive movements or attempting to evade law enforcement. As shown on [police body worn camera] Mr. Jones slowed his vehicle and came to a complete stop within 17 seconds. A reasonably objective officer would have no basis to conclude that a driver was attempting to flee or elude law enforcement with the undisputed facts at hand.”

The motion says there is no evidence a crime occurred, so the case should be dismissed, the news outlet reports.
Prosecutors asked the judge to give them a week to respond to the motion.

During a hearing on Monday, Jones’ attorneys asked the judge to remove his ankle monitor. The monitor was ordered by the court when he was arrested in April.

His attorneys told the judge “It is getting very costly.”

Julio Foolio’s trial date is set for Sept. 26.
