Judge Denies Rapper Boosie’s Badazz’s Motion To Dismiss Gun Charge In San Diego

SAN DIEGO- Cali- A San Diego judge has denied a motion by rapper Boosie Badazz, who was seeking a dismissal of his case on the argument that felons in possession of firearms are unconstitutional.

Attorneys for the rapper requested the dismissal last month, arguing that weapon bans for people convicted of non-violent felonies violate the Second Amendment under a new standard established last year by the U.S. Supreme Court, the San Diego Union Tribune reports.

The ruling means Boosie’s case will continue toward trial, according to the news outlet.

The rapper, whose real name is Torrence Ivy Hatch Jr. was arrested on May 6 during a traffic stop in San Diego. Police conducted a search of the car and allegedly found two loaded handguns.

Boosie pleaded not guilty in May to being a felon being in possession of a firearm.

If convicted, he faces up to three years in state prison.
