LOS ANGELES- The man accused of attacking comedian Dave Chappelle has requested to be transferred out of jail and into a mental health facility, according to his attorney.
Isaiah Lee, 23, appeared in Los Angeles Superior Court Monday morning, wearing a yellow prison top and blue pants, as his broken arm appeared to be healed, reports The New York Post.
Lee’s lawyer, Deputy Public Defender Chelsea Padilla, requested that her client be placed in a mental health diversion program.
Prosecutors will be going to file a motion to oppose the motion, and a hearing was scheduled for Aug. 23, reports the outlet.
Lee allegedly tackled Chappelle on stage for his “Netflix is a Joke” show in Los Angeles on May 3.
Lee was initially charged with felony assault with a deadly weapon, but his charges were later downgraded to a misdemeanor battery charge. He denied having mental illness, but later admitted to being diagnosed with Bi-Polar disorder.
He told The Post that he allegedly attacked Chappelle because he was “triggered” by LGBTQ jokes he had made, saying he identified as being Bi-Sexual.
