DaBaby’s Alleged Assault Victim Wants Lawsuit To Go Forward Despite Rapper Delaying It

LOS ANEGLES- A man who is suing rapper DaBaby for allegedly assaulting him is demanding that the lawsuit move forward despite the rapper’s plea to delay it, according to Radaronline.

The alleged victim, Gary Pager, went to court just days after DaBaby did.

DaBaby and his lawyers rushed to court last week, pleading for the $100,000 civil lawsuit against him be put on hold due to his criminal case, which is related to the same incident, according to court documents obtained by RadarOnline.

Page sued DaBaby, whose real name is Johnathan Kirk, last year. He claims that he rented his home out to the Charolette rapper and his crew in L.A., specifying in the lease how many people were allowed in the property.

DaBaby and his crew checked into the home on Dec. 2020, and Pager says to his surprise, the rapper was using the home to film a music video.

Pager says over 40 people were at his property, and he went to the premises to speak DaBaby about violating the terms of his lease, but things turned violent with the troubled rapper.

Pager says when he did arrive at his property, he says he was spit on and assaulted.

DaBaby then chased him into the home where he allegedly punched him in the face.

Pager says he lost a tooth as a result of being punched in the face and DaBaby told him not to call police before fleeing the scene with his crew ahead of officers arriving.

DaBaby left thousands of dollars in damages, according to the suit.

The rapper was charged with felony assault battery over the incident earlier this year by the L.A. County District Attorney’s Office.

DaBaby is asking the court to put the suit on hold until the case is over. His lawyer is claiming that the rapper would “thus not be able to respond to written discovery, answer deposition questions, or testify at trial in this case without potentially incriminating himself in the parallel criminal case,” reports RadarOnline.

Pager is asking a judge to allow the suit to proceed, saying DaBaby’s charges do overlap with the conduct at issues in certain causes but the rapper can plead the fifth if need be.

There is no ruling from the judge yet.
